  • Law of 20 December 2019 on the sanitary, hygiene, safety and liveability criteria applicable to housing and rooms put up for rent, or made available for residential use (Loi du 20 décembre 2019 relative aux critères de salubrité, d'hygiène, de sécurité et d'habitabilité des logements et chambres donnés en location ou mis à disposition à des fins d'habitation).
  • Grand Ducal Regulation of 20 December 2019 establishing the minimum sanitary, hygiene, safety and liveability criteria that housing and rooms put up for rent, or made available for residential use, must comply with (Règlement grand-ducal du 20 décembre 2019 déterminant les critères minimaux de salubrité, d’hygiène, de sécurité et d'habiltabilité auxquels doivent répondre les logements et chambres donnés en location ou mis à disposition à des fins d'habitation).

Declaring a room

Article 3 of the Law of 20 December 2019 on the sanitary, hygiene, safety and liveability criteria applicable to housing and rooms put up for rent, or made available for residential use, stipulates that:

any property owner or operator that leases, or makes available for residential use, one or more rooms is required to make a prior declaration to the mayor of the municipality, stating the maximum number of people that may live in said room(s). The declaration must also include a plan of the premises.

Establishments awarded the label

The label is awarded based on an analysis of the condition of establishment in question. The criteria assessed for the award of the label are as follows:

  • Construction
  • Cleanliness
  • Amenities
  • Building management

Article 4 of the Law of 20 December 2019 stipulates that:

without prejudice to the powers and competencies of medical inspectors and the Grand Ducal Police, the mayor has the authority to inspect said housing and rooms to ensure compliance with the criteria set out in Article 2(1).

Penalties

Article 7 of the aforementioned law stipulates that violations of Articles 2 and 3 are punishable by a fine of between €251 and €125,000 and imprisonment for a period of eight days to five years, or one of these penalties.
